Regulatory Disclaimer
Kensington Bridging Finance is a trading style of Construction Capital. We are not regulated by the Financial Conduct Authority (FCA). Some bridging loans are regulated by the FCA where they are secured against the borrower's primary residence. In such cases, we will refer you to an FCA-authorised broker. Your property may be repossessed if you do not keep up repayments on a mortgage or any other debt secured on it.
1. Introduction
These Terms and Conditions ("Terms") govern your use of the Kensington Bridging Finance website at https://kensingtonbridgingfinance.co.uk ("the Website") and the services provided by Kensington Bridging Finance ("we", "us", "our"), a trading style of Construction Capital.
By accessing and using this Website, you accept and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use this Website or our services.
2. About Us
Kensington Bridging Finance is a trading style of Lenzie Consulting Ltd. We operate as a bridging finance broker, arranging short-term property finance between borrowers and lenders. We are not a lender — we act as an intermediary, sourcing and recommending bridging finance products from our panel of lenders on your behalf.
3. Our Services
We provide bridging finance brokerage services, which include:
- Assessing your bridging finance requirements based on the information you provide.
- Sourcing suitable bridging loan products from our panel of lenders.
- Presenting terms, rates, and conditions from lenders for your consideration.
- Coordinating the application process between you, the lender, and professional advisers.
- Providing general information about bridging finance through our website content, calculator, and educational materials.
Our services do not constitute financial advice. We do not provide regulated financial advice, tax advice, or legal advice. You should seek independent professional advice before entering into any bridging finance arrangement.
4. Regulatory Status
The distinction between regulated and unregulated bridging finance is important:
- Regulated bridging finance: Where the loan is secured against a property that is, or will be, occupied by the borrower or a close family member as their main residence. These transactions are regulated by the Financial Conduct Authority (FCA) and must be arranged through an FCA-authorised intermediary. In such cases, we will refer you to an appropriate FCA-authorised broker.
- Unregulated bridging finance: Where the loan is secured against an investment property, commercial property, or any property that is not the borrower's primary residence. These transactions are not regulated by the FCA. The majority of bridging finance transactions in the Kensington market fall into this category.
5. No Guarantee of Finance
Submission of an enquiry or application through our Website does not guarantee that bridging finance will be offered or arranged. All lending decisions are made by the lenders on our panel, each of whom applies their own underwriting criteria. We cannot guarantee:
- That any lender will offer you finance.
- The terms, rates, or conditions on which finance may be offered.
- Specific completion timelines, which depend on multiple factors including lender processing times, valuation availability, legal due diligence, and your own responsiveness.
- That indicative terms provided at the Decision in Principle stage will be replicated in the formal offer.
6. Your Obligations
When using our services, you agree to:
- Provide accurate, complete, and truthful information about yourself, your financial circumstances, the property, and your intended use of the bridging finance.
- Promptly provide any additional information or documentation requested by us or the lender.
- Inform us of any material change in your circumstances that may affect your bridging finance application.
- Not use our services for any unlawful purpose, including money laundering, fraud, or terrorist financing.
- Not provide false or misleading information to us, lenders, valuers, or solicitors.
You acknowledge that providing false or misleading information may constitute a criminal offence and may result in the withdrawal of any offer of finance and/or legal action.
7. Bridging Finance Risk Warning
Bridging finance is a form of short-term secured lending. Before entering into a bridging loan agreement, you should be aware of the following risks:
- Your property is at risk: A bridging loan is secured against property. If you fail to keep up repayments or repay the loan at the end of the term, the lender may repossess and sell the property to recover the debt.
- Interest rates are higher: Bridging loan interest rates are typically higher than standard mortgage rates. Interest is charged monthly and can be rolled up (added to the loan balance), increasing the total amount owed.
- Fees and costs: Bridging loans involve various fees including arrangement fees, valuation fees, legal fees, exit fees, and broker fees. These costs can be significant and should be factored into your overall project appraisal.
- Exit strategy risk: Bridging loans require a clear exit strategy — the means by which you will repay the loan. If your exit strategy fails (for example, a property sale falls through or a refinance mortgage is declined), you may face default, penalty interest, and ultimately repossession.
- Market risk: Property values can go down as well as up. A decline in property values during the bridging term could affect your ability to refinance or sell at the expected price.
- Development and refurbishment risk: Construction and refurbishment projects may experience cost overruns, delays, or planning issues that extend the project timeline beyond the bridging loan term.
8. Website Content and Calculator
The content on this Website, including articles, guides, case studies, and the bridging loan calculator, is provided for general information purposes only. It does not constitute financial advice, tax advice, or legal advice, and should not be relied upon as such.
The bridging loan calculator provides indicative estimates only. The figures generated are based on simplified assumptions and may not reflect the actual terms, rates, or costs applicable to your specific transaction. Actual rates and fees will depend on a full assessment of your circumstances by the lender.
While we endeavour to keep the information on this Website accurate and up to date, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Website content. Information about interest rates, loan terms, and market conditions may change without notice.
9. Fees
Our fees for arranging bridging finance will be clearly disclosed to you before you proceed with any application. Typical fee structures include:
- Broker fee: A fee payable to us for our services in arranging the bridging finance. This may be a fixed fee or a percentage of the loan amount, and will be confirmed in writing before you instruct us to proceed.
- Lender arrangement fee: A fee charged by the lender, typically 1-2% of the loan amount. This is a lender fee, not a fee charged by us, though it forms part of the total cost of the facility.
You will not incur any fees for initial enquiries, Decisions in Principle, or using the information and tools on our Website. Fees only become payable when you instruct us to proceed with a formal application and the facility completes.
10. Intellectual Property
All content on this Website, including text, graphics, logos, images, data compilations, software, and the selection and arrangement thereof, is the property of Kensington Bridging Finance or its licensors and is protected by United Kingdom and international copyright, trademark, and intellectual property laws.

- We shall not be liable for any loss of profit, revenue, data, or business opportunity, whether direct or indirect.
- Our total liability to you in respect of all losses arising from or in connection with our services shall not exceed the total fees paid by you to us in respect of the relevant transaction.
- We shall not be liable for any losses arising from the actions, omissions, or decisions of lenders, solicitors, valuers, or other third parties involved in your transaction.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited by English law.
13. Anti-Money Laundering
We are subject to the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017. We are required to conduct customer due diligence checks, which may include verifying your identity, the source of your funds, and your business relationships. We reserve the right to refuse to provide services to any person or entity where we are unable to satisfactorily complete these checks.
14. Complaints
If you are dissatisfied with any aspect of our services, please contact us:
- Email: matt.lenzie@construction-capital.co.uk
- Phone: 020 3816 3693
We will acknowledge your complaint within 3 working days and aim to resolve it within 15 working days. If we are unable to resolve your complaint to your satisfaction, you may be able to refer it to the Financial Ombudsman Service (for regulated transactions) or seek independent legal advice.
15. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for details of how we collect, use, store, and protect your personal data.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this Website with an updated "Last updated" date. Your continued use of the Website after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
